A police officer cannot pull a car over without a legitimate reason. Automatic probable cause is given in the case of a traffic violation such as speeding, driving with your headlight turned off, or running a stop sign. Gray areas occur where the stop is conducted because the car was swerving in the lane or turn without the use of a blinker.
If the defense can establish that the officer did not have probable cause to make the stop the case will be dismissed for wrongful search and seizure. |
